RULES & REGULATIONS GOVERNING THE SEWER SYSTEM

Section 1

All property owners requesting sewer connections through Powder Mountain Water and Sewer Improvement District, shall be governed by the following rules and regulations, and all amendments or additions there to and said rules and regulations together with all amendments and additions there to are part of this contract of every property owner who purchases a sewer connection from the District. These rules and regulations are subject to change any time by the Board of Trustee’s without notice. Any matter not expressly covered by a rule or regulation shall be determined by the Board of Trustee’s as the problem raises.

1.1 APPLICATION FOR SEWER BY A PROPERTY OWNER
Application for Sewer Connections must be made to the District Office by the property owner of the property of the property requesting the sewer services on forms provided by the district.

1.2 PAYMENT SCHEDULE
Sewer payments are due on the 15th day of the month for Sewer billing. Billing is monthly determined by the Board of Trustee’s and may change as determined necessary.

1.3 CONNECTION APPLICATION FOR EACH UNIT
A separate connection to the main sewer line, as approved by the District, is required for each dwelling, commercial or other inhabited buildings.

1.4 SIZE CONNECTION REQUIRED
Minimum size for dwelling 4” as defined by Utah State Code
Minimum size for commercial building 4” as defined by Utah State Code

1.5 ALTERATIONS TO SYSTEM
No alterations or extensions shall be made in any district main except as approved by a District licensed contractor shall give 24 hours notice before work begins. Inspections by the District personnel will be required. Work must conform to all state and local codes.

1.6 PROPERTY ACCESS
District employees are to have access at all reasonable hours to the premises to see that all rules are observed and to make any necessary inspection or repairs to the sewer system.

1.7 SEWER LINE RESPONSIBILITY
Sewer lateral from main to the structure, residence, or commercial building are the responsibility of the property owner and must be repaired and kept in good condition under the direction of the District. All work on lines must be performed by a license contractor.

1.8 CONNECTION TO THE MAIN SEWER SYSTEM
All connection applications will be through the District by the property owner or their licensed contractor. Notice that a connection is required is required must be given to the District 24 hours previous stating names of the applicant, address and names of the contractor. Connection inspections will be made as soon as a District agent is available. Connection costs are the responsibility of the property owner.

1.9 CONNECTION CHARGES
The connection charge shall be $6,500.00, six-thousand five-hundred, plus a $500.00, five-hundred dollar inspection fee for each connection throughout the service area the District serves.
The connection fee does not cover the cost of service lateral from the main to the property. Connection fees are due upon application for the building permit.

1.10 FEES
1. A non-connect sewer fee will be charged per month.
2. A connected sewer fee will be charged per month upon issuance of Occupancy Permit from Weber County.
3. A late notice fee will be charged on all notices sent out on accounts which have not been paid by the 20th of the month.
4. If your bill for your service assessment becomes over 90 days (ninety days) delinquent you will forfeit your connection ownership and may have to reapply for a connection, and pay connection fees depending on supply and demand. A connection may not be available.
5. A termination notice will be sent out to you to correct the default and following notification of termination all back fees will be due.
6. New accounts become payable on the 20th day of the month.
7. Property owners will be considered properly notified by sending notification to the last address on record.

1.11 SUBDIVISION, CONDOMINIUMS & OTHER DEVELOPMENT PROJECTS
Powder Mountain Water and Sewer Improvement District will whenever possible supply sewer to the nearest project boundary upon application by the Developer. Charges for extension line will be at a rate agreed upon by the District and Developer. All lines within the Subdivision or projects will be at the expense of the developer and shall be of standards which meet approval of the District and all local County, State and Government regulations. All lines must be inspected and have a written approval before covering lines. After completion and acceptance of the newly installed main lines they will become property of the District for operation and maintenance.
